School rights for children experiencing homelessness in California
Housing instability should not automatically interrupt a child's education. Federal law provides protections, and every school district must designate a liaison for students experiencing homelessness.
Who may qualify?
The California Department of Education explains that McKinney-Vento includes children and youth who lack a fixed, regular, and adequate nighttime residence. This may include sharing housing because of housing loss or hardship, living in a motel or shelter, or sleeping in a car, park, public space, or similar setting.
Important protections
- Immediate enrollment even when normally required records are unavailable
- The ability to attend the school of origin or the school near the temporary residence, depending on circumstances and best interest
- Transportation to the school of origin when applicable
- Access to the same free, appropriate public education and participation opportunities provided to other students
- Help from the school district's designated homeless education liaison
What to say to the school
Ask: “Who is the district's McKinney-Vento homeless education liaison?” Explain the child's living arrangement and that it resulted from housing loss, economic hardship, or another qualifying circumstance.
If you disagree with a decision
Ask the liaison for the district's written dispute process and an explanation of the decision. Keep copies of messages and note names and dates.
